Developers proposing 622 new units in Waterloo appeals to the Ontario Land Tribunal

WATERLOO — A developer proposing a mixed-use development with 622 units has requested an Official Plan and zoning amendment. 

The subject lands are 109, 115, and 133 Bridgeport Road East and 30 Weber Street North; the properties’ developers and owners are 115 Bridgeport Inc. and 1648386 Ontario Limited. 

A proposal for the project includes a new multi-tower development with three towers, 785 bedrooms, and 345 square metres of at-grade commercial space.

 The developer plans to provide 569 vehicle parking spaces on levels one through four of a proposed podium for the building and within a 6-storey parking structure which fronts Royal Street on the east portion of the property.

Official Plan and zoning amendment applications were submitted to request an increase in density, permitted building height, and a reduction in the required parking space ratio. 

The subject lands are currently zoned mixed-use community commercial 40 (C1-40), mixed-use medium-high density residential (RMU-40) and mixed-use medium-density residential (RMU-20) in Bylaw 2018-050, as stated in the Planning Justification Report. 

A request for rezoning most of the subject lands is stated in the Planning Justification Report as follows, “To implement the Official Plan Amendment, a Zoning Bylaw Amendment is proposed to rezone the lands to the C1-81 and RMU-81 zones, . . . save for the portion of the site zoned RMU-20, which is not proposed to change. The development complies with the regulations of the C1-81, RMU-81 and RMU-20 zones, except for parking . . . .” 

The zoning amendment requests to reduce the required parking space ratio of 1.0 space per unit to 0.8 spaces per unit, with visitor parking remaining the same for a portion of the properties. 

Another change for parking requirements requests to allow 2.4 spaces per 100 square metres of commercial space, whereas 3.2 spaces are required for the lands with the C1-81 zoning.

 It also requests an increase in building height from the maximum permitted height of 40.0m to the requested 81.0m. The tower heights will range from 22 to 25 storeys (including the podium’s height). 

The Official Plan amendment requests to permit the same increase in building height as the zoning amendment and requests to re-designate a portion of the properties from the current medium-high and re-designate it to high density.

 Requesting to re-designate a portion of the subject lands allows the development proposal to take place. 

The developers have appealed to the Ontario Land Tribunal due to the municipality’s lack of a decision within the required timeframe. A decision has yet to be made for the development.
