KITCHENER — A Zoning By-law Amendment for 75 First Avenue in Kitchener was approved by the city council on August 26, 2024, following a recommendation from the planning committee earlier that month.
The amendment, sought by property owner Jason Dale, rezones the site from ‘Low Rise Residential Four Zone (RES-4)’ to ‘Low Rise Residential Five Zone (RES-5)’ with a Site-Specific Provision (404).
The change allows for the addition of three new residential units to the existing three-unit multiple dwelling, bringing the total to six units.
The approved development includes five surface parking spaces at the rear of the property despite zoning regulations typically requiring six spaces.
The reduction is deemed acceptable due to the property’s location on a major bus route, which reduces dependency on automobiles.
Additionally, the amendment allows for reduced setbacks, including a 1.28-metre interior side yard and a 1-metre rear yard for the parking area.
Other site-specific provisions include an increase in the Floor Space Ratio (FSR) from 0.6 to 0.63 and the elimination of the requirement for ground-floor units to have patio areas.
These adjustments were supported by city staff, who cited the property’s proximity to parks and public spaces as mitigating factors.
The existing driveway, with a narrower width at the front, is also permitted to remain under the new regulations.
The development aligns with the city’s goals for gentle intensification in established residential areas and supports transit-oriented growth.
The amendment was considered consistent with local and regional planning policies, contributing to sustainable urban development in Kitchener.
