BRANTFORD — On January 9, 2025, the Committee of Adjustment will review a consent application for a proposed residential project at 35 Eighth Avenue. The application, submitted by Peter and Norma Takacks and represented by Domenic Reale, aims to sever the property into two parcels to enable the construction of a new single detached dwelling.

Proposal Details:

  • Severed Lot:
    • Area: Approximately 528 square metres.
    • Frontage: 14 metres.
  • Retained Lot:
    • Area: Approximately 437 square metres.
    • Frontage: 12 metres.

Both lots meet the minimum zoning requirements under Zoning By-law 160-90.

The existing single detached dwelling will remain, while the accessory structure on the site is slated for demolition.

Floodplain Considerations:

The property is located within a floodplain associated with the Grand River and falls under Special Policy Area 1 of the City’s Official Plan. Development on the severed parcel must comply with floodplain management policies, including:

  • Prohibition on basements.
  • Elevated first-floor levels to mitigate flood risks.

Zoning Context:

  • Current Zoning: Flood – Residential Type 1C (12 Metre) Zone (F-R1C).
  • Proposed Zoning: Neighbourhood Low-Rise (NLR) under the City’s updated Zoning By-law 124-2024 (pending appeal at the Ontario Land Tribunal).

This proposal supports residential intensification goals while maintaining the neighbourhood’s character.

Neighbourhood Integration:

The proposed severance aligns with the surrounding area, which consists primarily of single detached homes. The project adds a modern residential dwelling while adhering to flood management policies and zoning requirements.

The Committee of Adjustment will consider the application during its meeting on January 9, 2025, to determine whether the proposal can move forward.
